It is the case of the petitioner that his father was an employee at Burdwan Raj College, Purba Burdwan, who died in harness on July 02, 2016. The petitioner claims compassionate appointment.

The college constituted a committee for the purpose of giving compassionate appointment to the petitioner. But till date respondents have taken no effective steps thereafter.

I am of the view that the prayer of the petitioner cannot be entertained on the sole ground that the University of Burdwan Act, 1981 or the Statutes framed thereunder do not provide any provision for compassionate appointment. Unless there is any

scheme, statute or notification issued by the competent authority for compassionate appointment, an appointment on compassionate cannot be granted. Therefore, this writ petition is not entertained, and accordingly WPA 25261 of 2022 is dismissed. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
