Writ petition is taken up for consideration in presence of learned advocates representing State respondent, Rishra Municipality and respondent No.5. Learned advocate of the deceased petitioner submits that till date he has not received any instruction for taking steps in view of death of the sole writ petitioner.
The matter was heard on 14th June, 2023 when it was informed to this Court that the writ petitioner died and taking into consideration death of the writ petitioner hearing of the writ petition was adjourned in order to enable the learned advocate representing the deceased petitioner to take necessary steps.
It has been submitted on behalf of the respondent No. 5 that the writ petitioner during his life time sold out
his share in the property in question to the respondent No. 5 on 19th September, 2022.
In view of the submission made on behalf of the respondent No. 5 it appears that due to transfer of title of the petitioner's share to the respondent No. 5 by execution of sale deed the writ petition had become infructuous. Subsequently, the writ petitioner has died. Accordingly, it appears nothing remains to be decided on the writ petition and the same stands dismissed.
