The petitioner is aggrieved by the disturbance created by the respondent No. 6 who happens to be the maternal uncle and it has been alleged that the petitioner is pressurizing to withdraw the criminal case arising out of Watgunge P.S. Case No. 05/2023 which is under the relevant provisions of the IPC and the POCSO Act. Learned Advocate for the State has submitted a report. As the primary allegations of the petitioner is that at the behest of the respondent No. 5 (who is an absconding accused) the respondent No. 6 is pressurizing the petitioner to withdraw the case, I direct that the Deputy Commission of Police-in-Charge of Watgunge Police Station would treat the information which was furnished to the Watgunge Police Station on 04.01.2024 as a complaint under the Witness Protection Scheme, 2018.

The concerned Officer would takes steps according to the Scheme and submit a threat perception report before the learned Principal Magistrate, Juvenile Justice

Board, Calcutta in seisin of the matter. On an assessment of the report so submitted appropriate precautionary measures as the learned Principal Magistrate, Juvenile Justice Board, Calcutta deems fit and proper be passed so that the progress of the case is not hindered. Learned Principal Magistrate, Juvenile Justice Board, Calcutta would also take measures for issuing harsher process of law for tracing out the absconding respondent No. 5.

With the aforementioned observations, the instant writ petition being WPA 25576 of 2024 is hereby disposed of.

Report so submitted be kept with the record.

Parties shall act on the basis of the server copy of this order duly downloaded from the official website of this Court.
