The writ petition is taken up for consideration pursuant to the order dated 14th June, 2023 in presence of the learned advocates representing the petitioner, Rishra Municipality and the respondent No. 5. However, it has been submitted by the learned advocate representing the petitioner that he has not received any instruction from the petitioner. Learned advocate representing the respondent No. 5 submits that the petitioner's share in the property in question was sold out to the respondent No. 5 on 16th January, 2023.

In view of such submissions made on behalf of the respondent No. 5 it appears that the writ petition has become infructuous.

Accordingly, the writ petition stands dismissed. Interim order, if any, stands vacated.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
