Petitioners complain that in spite of informing the Officer-in-charge, Tangra Police Station no steps have been taken in respect of the wrongful acts perpetrated by the private respondents.

Primarily the accusations are related to a construction of a tin shed at the common roof by the respondent nos. 5 & 6 which was resisted by the petitioners, consequent to which the petitioners were threatened and they have been harassed by throwing garbage materials at their place of occupation.

Learned advocate appearing for the State submits that there is purely a private dispute between the petitioner and the private respondents. The inter se disputes are of such nature that until

and unless the civil court decides the issue relating to the rightful or wrongful construction of the tin shed, it would be difficult for the police authorities to interfere in such situations.

Be that as it may, in case inconveniences are faced by the petitioner as it has been stated, petitioner no. 1 is a cancer patient, the police authorities would ensure that there is no breach of the peace and/or tranquility and/or any untoward incident resulting from the strained relationship existing between the petitioner and the private respondents.

With the aforesaid observations WPA 25552 of 2024 is disposed of.
