Learned advocate for the petitioners submits that 73 kgs of ganja were recovered from a car. However, there are no materials connected to the present petitioners and the petitioners are unnecessarily languishing in jail for 342 days. Learned advocate also submits that there has been no progress in the trial, inspite of the charge-sheet having been submitted.

Learned advocate for the State opposes the prayer for bail and submits that commercial quantity of contraband were recovered from the possession of the petitioners and no plausible explanation has been offered.

Having regard to the facts of the case, I am of the opinion that the petitioners have failed to overcome the rigours of Section 37 of the NDPS Act.

Hence, the prayer for bail of the petitioners is Rejected.

The learned trial court would take steps for expedite the progress of the trial Accordingly, CRM (NDPS) of is dismissed.
