As the petitioner prays for steps to be taken against the public servant by way of information furnished with the police authorities, I am of the view that since specific procedure has been incorporated in the BNSS by way of Section 175(4), there is an alternative efficacious remedy available to the petitioner.

As such, the petitioner, if so advised, would follow the procedure and approach the jurisdictional Magistrate. The learned Magistrate would, under those circumstances, assess as also ascertain regarding the genuinity of the allegations, thereafter, pass necessary directions as he/she deems fit and proper.

With the aforesaid observations, WPA 25534 of 2024 is disposed of.
