Numir Mallick v. Mabila Bibi
23.07.2021 Item no.15 Ct. No.34 CHC C.R.R. No.4012 of 2011 (Via Video Conference) In Re: An application under Section 482 of the Code of Criminal Procedure, 1973.
AND In the matter of:- Numir Mallick ... petitioner The present revisional application has been preferred against the judgement and order dated 2nd August, 2011, passed by the learned Judicial Magistrate, 2nd Court, Krishnagar, Nadia, in MR Case No.692 (IV) 10/T.R. 1191 of 2010 under Section 125 of the Code of Criminal Procedure.
It is reflected from the records that the learned Magistrate directed the present petitioner to pay Rs.800/- per month to the wife and Rs.650/- per month to the minor son towards maintenance. The quantum so decided by the learned Magistrate is meagre amount of money, which is not even bare minimum required for an individual to survive. As such, no interference is called for.
Accordingly, C.R.R.4012 of 2011 is dismissed. Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.
All parties shall act in terms of copy of this order downloaded from the official website of this Court.
