The petitioner claims to be the owner of Dag No.367 within Mouza-Dasghora under Police Station-Goghat in the District of Hooghly.
The petitioner states that there is a PWD road adjacent to the aforesaid property of the petitioner and the private respondents have raised an illegal and unauthorised construction on the PWD road thereby obstructing the ingress and egress of the petitioner from his property to the PWD road.
The petitioner submitted a representation dated September 15, 2025 before various authorities. The learned advocate appearing for the petitioner submits that in spite of receipt of the said representation
no steps have been taken by the respondent authorities till date.
Mr. Banerjee appears for the private respondents. He denies the allegation of the petitioner.
The learned advocate appearing for the State submits that immediately upon receipt of the representation of the petitioner the Assistant Engineer, Arambagh Highway Sub-Division, Public Works (Roads) Directorate by a letter dated November 20, 2025 requested the Block Land & Land Reforms Officer to demarcate the government land alongside the Arambagh-Gogha Ramjibanpur Road (State Highway-7) in front of the Plot No.367 within Mouza-Dasghora, Block-Goghat-II, J.L. No.80.
Since an allegation of encroachment upon the PWD road has been made it is the duty of the respondent authority to take steps in accordance with law. Considering the fact that the Assistant Engineer, Arambagh Highway Sub-Division, Public Works (Roads) Directorate has requested the Block Land & Land Reforms Officer, Goghat-II Block to demarcate the government land alongside the State Highway No.7 in front of the Plot No.367, the Block Land & Land Reforms Officer, Goghat-II Block being the added respondent is directed to undertake the exercise of demarcation as requested by the Assistant Engineer, Arambagh Highway Sub-Division, Public Works (Roads) Directorate being the respondent No.4 and to
complete the entire exercise in accordance with law as expeditiously as possible but positively within a period of 4 weeks from the date of receipt of a server copy of this order.
After the work of demarcation is completed the sketch map shall be forwarded by the added respondent to the respondent No.4 immediately thereafter. If upon receipt of the said report it is found that there has been encroachment upon the State Highway, the Assistant Engineer, Arambagh Highway Sub-Division, Public Works (Roads) Directorate being the respondent No.4 shall take steps in accordance with the provisions laid down under Section 10 of the West Bengal Highways Act, 1964 and complete the entire exercise under the said provisions as expeditiously as possible but positively within a period of 4 weeks from the receipt of a cop of the report from the concerned Block Land & Land Reforms Officer, Goghat-II Block.
With the above observations WPA 25405 of 2025 stands disposed of.
There will be no order as to costs.
