In the matter of : An application under Section 482 of the Code of Criminal Procedure.
In an application under Section 125 of the Code of Criminal Procedure, the learned Judicial Magistrate(1st Class), 1st Court, Suri, Birbhum by an order dated 8th September, 2011 was pleased to award maintenance of Rs.1800/- per month to the opposite party/wife.
Being aggrieved by such award of maintenance, the present petitioner approached the learned Sessions Judge, Birbhum in Criminal Motion No. 55 of 2011 and the learned Sessions Judge on an appreciation of the materials so considered by the learned Magistrate was pleased to dismiss the revisional application and affirmed the award of maintenance passed by the learned Magistrate. Having regard to the quantum of maintenance so awarded by the learned Magistrate and affirmed by the learned
Sessions Judge, Suri, Birbhum, I am of the view that the same do not call for any interference by this court. As such, the present revisional application being CRR 4021 of 2011 is dismissed.
All pending applications, if any, are consequently disposed of.
Interim order, if any, is hereby vacated.
The opposite party/wife will be at liberty to recover the arrears by taking out an appropriate application before the learned Magistrate.
