Mr. Debasish Banerjee Mr. Sirsendu Sinha Roy ...for the Petitioner Mr. Gourav Das ...for the State By presenting this writ petition the petitioner has prayed for necessary direction for providing appointment on compassionate ground in view of untimely death of her father on 12th March, 2013 who was working in the post of Assistant Teacher in Government aided recognised high school.

The learned advocate representing the petitioner had drawn attention of this Court to one letter of the headmaster of the school where petitioner's father was working dated 21st November, 2013 addressed to the District Inspector of Schools (SE), South 24 Parganas being the respondent no. 4 whereby the application of the petitioner for providing appointment on compassionate ground was forwarded to the respondent no. 4. The grievance of the petitioner is in spite of approach was made by the said school authority vide letter dated 21st November, 2013 to the respondent no. 4 till date no decision has been taken.

State-respondents are represented by Mr. Gourav Das, learned advocate.

This Court has heard the learned advocates representing the parties and perused the relevant materials wherefrom it appears that after the death of the father of the petitioner application was made by the petitioner for being appointed on compassionate ground which was duly forwarded by the school authority vide letter dated 21st November, 2013 to the respondent no. 4. Subsequently, said respondent no. 4 has not taken any decision on the claim of the petitioner.

This Court directs the respondent no. 4 to take decision on entitlement of the petitioner to be appointed on compassionate ground within a period of 8 (eight) weeks from the date of communication of this order after granting opportunity of hearing to the petitioner and to pass a reasoned order. Decision to be taken by the respondent no. 4 shall be communicated to the petitioner within 1 (one) week thereafter.

With the above direction, the writ petition stands disposed of.

However, there shall be no order as to costs. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
