Kausik (Rejected) CRM (NDPS) 1412 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Goalpokher Police Station Case No. 16 of 2023 dated 16.01.2023 under Sections 21(c) of the NDPS Act.

Learned advocate appearing for the petitioner submits that from an underconstructed building certain recoveries were made and the petitioner being owner of the building has been unnecessarily harassed by being implicated in connection with the instant case.

It is submitted that the petitioner surrendered before the learned Special Court and for a period of 116 days he is in custody.

On the other hand, learned advocate appearing for the State submits that case was registered in the year 2023. Charge sheet was submitted in the year 2025 and the petitioner surrendered in July 2025.

Having considered that the petitioner was initially evading the process of law, I am not inclined to release the

petitioner on bail at this stage. Petitioner is granted liberty to approach this Court after the examination of the seizure list witnesses are over.

At this stage CRM (NDPS) 1412 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
