BELA BIBI Mr. Bidyut Kumar Roy Ms. Rita Datta .... for the State The matter is listed today as 'Motion'. On call none appears for the petitioner and the opposite party. The petitioner filed this revisional application against the judgement and the order dated 11.08.2011 passed by the learned Judicial Magistrate, 2nd Court, Krishnagar, Nadia in M.R Case No.274(iv)/10/T.R No.410 of 2010 under Section 125 of the Code of Criminal Procedure. On earlier occasion the petitioner was directed to deposit Rs.1,200/- before the executing court within a period of two weeks from date and further ordered that there will be a stay of further proceeding in Misc. Execution Case No.178(iv)/11 for a period of eight weeks if the payment was made. In default, the Magistrate shall be at liberty to proceed against the petitioner. More than 10 years have passed in the meantime. The petitioner has not turned up with any compliance report nor did he file any affidavit of service within three weeks. Considering all these aspects, the revisional application stands dismissed for default of the petitioner.
