(Item No. 23) (AB) Mr. Uttiya Ray ...... for the petitioners Mr. Subhasis Bandyopadhyay ..... for the Municipality The petitioners' grievance is that though the mutation fees in respect of holding No. 15 of Mahajantuli has been paid, mutation has not been done by the Burdwan Municipality in the assessment book.

The petitioners made several representations praying for incorporation of their names in the assessment book and claims that the same has not been taken into consideration till date.

The petitioners submit that as the mutation has not been made in the assessment book they are not able to clear the municipal dues.

The learned advocate for the Municipality does not have any instructions in the matter.

As it appears that the representation of the petitioners is pending consideration at the end of the Municipality, no useful purpose will be served by keeping the writ petition pending.

The writ petition is accordingly disposed of by directing the Burdwan Municipality, through its concerned officer, to take necessary steps for

consideration of the representation dated 11th November, 2019 made by the petitioners, strictly in accordance with law, after giving an opportunity of hearing to the petitioners, at the earliest, but positively within a period of twelve weeks from the date of communication of a copy of this order and pass a reasoned order and communicate the same to the petitioners immediately thereafter.

The petitioners are directed to forward a copy of their representation dated 11th November, 2019 along with supporting documents at the time of communicating the order of the Court.

The writ petition stands disposed of.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon completion of usual legal formalities.
