Learned advocate for the petitioner submits that the present case being Complaint Case No. 243C/2020 under Section 138 of the N. I. Act is pending before the learned Judicial Magistrate, 5th court, Howrah.

Learned advocate submits that 26 dates have been fixed but after examination under Section 251 of the Code of Criminal Procedure till date none of the witnesses have been examined. In view of the fact that more than 3 years have passed since the initiation of the case, I direct that in case an application under Section 143A of the N. I. Act is filed before the learned J. M., 5th court, Howrah. The learned trial court would give effect to the intention of the legislature by passing appropriate orders. The case has been fixed on 5th February, 2024. Learned Magistrate on and from the next date would fix one date in a month for the purposes of the trial so that the trial of the case can be taken to its logical conclusion.

No unnecessary adjournments be granted to any of the parties.

All stake holders would cooperate to conclude the trial at the

earliest.

With the aforesaid observations, the revisional application being CRR 4126 of 2023 is disposed of.

Pending any other applications, if any, are consequently disposed of.
