Mr. Sabyasachi Banerjee, Sr. Adv, Mr. Pawan Gupta Ms. Diksha Ghosh ...for the de-facto complainant Learned senior advocate appearing for the petitioner submits that the petitioner is in custody for 26 days and has not fled away from the process of law.

Learned advocate for the State is present and opposes the prayer of bail. Case Diary has been produced before this Court.

Mr. Banerjee, learned senior advocate appearing on behalf of the de-facto complainant is aggrieved by the fact that the initial interim order of stay of the investigating was obtained by the petitioner, for which the investigation of the case has been jeopardized.

In view of the period of detention of the petitioner and the fact that the case is based on documents, I am inclined to allow the petitioner on bail.

Petitioner shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Chief Judicial Magistrate, Calcutta.

If on bail, the petitioner shall meet with the investigating officer for twice a week in the next three months and shall not enter the jurisdiction of New Market Police Station. Petitioner shall inform his address to the investigating officer of the case and make himself available as and when called for. Accordingly, CRM (R) 138 of 2025 is allowed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
