After hearing the submissions made on behalf of both the parties, it appears that there is an issue with regard to the calculation of the interest amount payable to the petitioner.

According to the Bank excess amount has been paid to the petitioner and the Bank seeks refund of the excess amount.

Learned advocate representing the petitioner submits that certain amount is still due and payable from the Bank.

Such disputed question of calculation can neither be decided nor fixed by the writ Court. 5.

Accordingly, the Assistant General Manager of the Asset Recovery Branch of the Union Bank of India (e-Andhra Bank), is directed to grant an opportunity of hearing to the petitioner and thereafter take a decision as to whether any amount is due by any party.

The Assistant General Manager of the Bank shall take all necessary steps in the matter to resolve the issue.

The petitioner is directed to co-operate with the Bank for the purpose of arriving at a conclusion to the problem that is being faced by the parties. 8.

The writ petition stands disposed of.

Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
