IN THE HIGH COURT AT CALCUTTA

Item No.64 CRIMINAL REVISIONAL JURISDICTION Ct.No.34 dc.

C.R.R. 2887 of 2013 Amit Kumar Sarkar @ Amit Kr Sarkar @ Amit Sarkar versus Joyita Ghosh (Sarkar) @ Pinki In Re: An Application under Section 401 read with Section 482 of the Code of Criminal Procedure.

Mr. Navanil De, Mr. Rajeshwar Chakraborty, Mr. S. Ghosh, Mr. Subhrajit Dey ... For the Petitioner.

Mr. De, learned advocate appears on behalf of the petitioner.

The subject matter of this revisional application relates to an order dated 30.05.2013 passed by learned Judicial Magistrate, Kandi, Murshidabad in Misc. Case No. 106 of 2011 under Section 125 of the Code of Criminal Procedure. The order dated 20.08.2013 passed by a co-ordinate Bench reflects that there was a direction for service. However, there was no interim order in respect of the proceedings pending before the learned court below. Presumably in the last 7 and 1/2 years there has been a total change of the nature of the proceedings and the purpose for which this revisional application was preferred before this Court. In case, the proceedings are pending, the petitioner would be at liberty to canvass the points agitated in the present revisional application before the learned trial court.

However, so far as the consideration of the issues before this Court is concerned, by efflux of time, the same has become infructuous. As such, no interference is called for.

Accordingly, the revisional application being CRR 2887 of 2013 is disposed of.

Interim order, if any, is hereby vacated.

All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
