27.11.2025 rc/ct.no.05 Item No.19 WPA No. 25292 of 2025 Mrs. Purabi Saha

Versus

The State of West Bengal & Ors.

Mr. Amitabha Ghosh ..for the Petitioner Mr. Ranjit Rajak ... for the State Ms. Mousumi Bhowal Mr. Ishan Bhattacharya ... for the South Dumdum Municipality Mr. Souma Subhra Ray Mrs. Aditi Chatterjee Mrs. Anushree Mondal Roy Ms. Neelam Kumari Ms. Archana Bhaghel ... for the Respondent Nos. 7,8&9 Affidavit of service filed by the petitioner and report submitted by the State are taken on record.

Heard learned counsels for the parties.

Learned counsel for the petitioner submits that the petitioner is a septuagenarian lady and is the owner of the premises in question. She ordinarily resides with her son in Delhi for her treatment and frequently visits her ancestral property. The private respondents insisted on her selling the property in their favour and on her refusal, pressurized her to do so. On one of her visits to the property, she found that the property was demolished by the private respondents who have put up a board therein

in the name of "Nirmala Group". The petitioner seeks police protection to protect her property.

Learned counsel for the private respondents submits that the petitioner's father sold out the property to Partha Sarathi Mitra and Amitava Mitra and private respondents have entered into the development agreement in respect of the said property with the said owners.

Learned counsel for the State submits that both the parties claim to be owners of the property and have produced documents in respect of their respective contentions.

The dispute appears to be civil in nature, both the parties claiming title in respect of the property in question. The petitioner is at liberty to approach the appropriate forum for redressal of her grievance. In the meantime, the police authority shall keep strict vigil over the area in order to maintain peace and tranquility therein and render necessary assistance and protection to the petitioner as and when required. With the above observations and directions this writ petition is disposed of.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.

Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
