Learned advocate for the petitioner submits that he has been taking into custody on the basis of statement of coaccused and since then he has suffered for about 58 days. Learned advocate for the State has submitted a report. Report prima facie reflects that only on the statements of the co-accused, the petitioner has been implicated and after the CDR was checked, incriminating materials were lacking so far as the present petitioner is concerned.

Having regard to the stand taken by the State in the report so submitted by the Investigating Officer of the case, I am of the view that further detention of the petitioner is unwarranted.

Accordingly, the prayer for bail of the petitioner is allowed.

Petitioner, namely, Rintu Sarkar shall furnish bond of Rs. 20,000/- (Twenty Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten Thousand Only) each. One of whom must be local to the satisfaction of the learned Special Judge, NDPS Act, Dakshin Dinajpur.

If on bail, the petitioner shall meet with the Investigating Officer once in a week till the charge sheet is submitted before the jurisdictional Court.

Accordingly, CRM (NDPS) 1418 of 2025 is allowed. Report submitted on behalf of the State be kept with the record.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
