After some arguments learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to move an appropriate application before the learned Trial Court for reconsideration of the maintenance after taking into account the affidavit of income and expenditure on the proper format in terms of the judgment of the Hon'ble Supreme Court in Rajnesh Vs. Neha & Anr. reported in (2021) 2 SCC 324.

2. Liberty granted.

3. In view of the submissions made, the petition is dismissed as withdrawn.

4. It is made clear that this Court has not gone into the merits of the case and no expression made therein shall tantamount to be an expression on the merits.
