Kausik (Rejected) CRM (NDPS) 1415 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Berhampore Police Station Case No. 503/2025 dated 12.03.2025 under Sections 20(b)(ii)(c)/29 of the NDPS Act.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 8 months and till date the charge has not been framed by the learned Special Court. Although the investigation has been concluded and charge sheet has been submitted before the jurisdictional Court. Learned advocate for the State is present. Case diary has been produced.

I find that huge volume of contraband/Ganja was recovered from the constructive possession of the petitioner. Having considered the materials appearing in the case diary in view of the present petitioner, at this stage, I am not inclined to release the petitioner on bail.

State is directed to expedite the process of trial. Learned Special Court would within a period of 60 days complete the process of consideration of charges and thereafter fix schedule each and every month so that the trial of the case can be progressed expeditiously.

With the aforesaid observations, at this stage, CRM (NDPS) 1415 of 2025 is dismissed.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
