Petitioner is aggrieved by the fact that he is being restrained from either entering his land and/or the respondents are trying to uproot the plantation and as such the petitioner has approached this Court for protection of his life, liberty and property.

Learned advocate for the private respondents opposes such contention and submits that the parties are already contesting before the Civil Court.

Learned advocate for the petitioner has drawn the attention of the Court to the order passed by the learned Civil Judge, Junior Division, 1st Court, Burdwan in T.S. 335 of 2024.

State has submitted a report reflecting that pursuant to the complaints made by the petitioner Raina Police Station Case No. 347 of 2024, dated 02.09.2024 was registered for investigation and subsequently on or about 30th September, 2024 charge sheet has been submitted before the jurisdictional Court.

As the petitioner has already approached the Civil Court I grant liberty to the petitioner to pray for appropriate relief for Police protection in response to the issues relating to the Civil Suit concern.

So far as the protection of the present petitioner is related, police authorities would keep a strict vigil and ensure that no untoward incident takes place and there should be no breach of peace and tranquility on the subject issue relating to the land where the petitioner and the respondents are at loggerheads in respect of crop, cultivation and harvesting.

With the aforesaid observations being WPA 25780 of 2024 is disposed of.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
