Rakib (Allowed) CRM (M) 2253 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Hariharpara Police Station case no. 272 of 2024 dated 09.05.2024 under Sections 363/365/34 of the Indian Penal Code, 1860 and adding Section 376(3) of the Indian Penal Code and 6 of POCSO Act, 2012.

Learned advocate appearing for the petitioner submits that the petitioner is in custody for four months 27 days and in spite of the charge-sheet having been submitted there has been no progress in the case.

Learned advocate for the de-facto complainant is present.

Learned advocate appearing for the State has produced the Case Diary.

I have considered the statement of the victim girl under Section 164 of the Code of Criminal Procedure, I am of the view that further detention of the present petitioner is unwarranted

in the facts and circumstances of the case. Accordingly, the prayer for bail of the petitioner is allowed. As such the petitioner namely, Soriful Sk shall furnish bond of Rs. 20,000/- (Rupees Twenty Thousand only), with two sureties of Rs. 10,000 (Rupees Ten Thousand only) each, one of whom must be local to the satisfaction of the learned Judge, Special Court under POCSO Act, Murshidabad at Berhampore. If on bail, the petitioner shall be physically present on each and every date before the learned trial Court in seisin of the case. The petitioner shall not leave the jurisdiction of district of Murshidabad without the prior permission of the learned Special Court.

Accordingly, CRM (NDPS) No. 2253 of 2025 is allowed. Case Diary be returned to the learned advocate appearing for the State.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
