1. Affidavit-of-service filed be kept with the record.

2. On being served, none appear for the respondents.

3. Mr. Amrit Lal Chakravorti, the Learned empanelled Counsel of the West Bengal present in Court is appointed to represent the State. Let his appointment be regularized.

4. The writ application has been preferred praying for direction upon the respondent Sub-Divisional Controller of Food And Supplies, Kakdwip Sub-Division, South 24 Parganas, respondent no.4 to rescind/cancel

and/or withdraw the selection and issuance of license in favour of the private respondent for Fair Price Shop (FPS) Dealership Village for Akshaynagar, Satishnagar, (Central Location-Sathishnagar, Berar Chak FP School), under Mouza Akshaynagar - 38, Post Office- Akshaynagar, Police Station-Harwood Point Coastal, under Kakdwip Block, District - South 24 Parganas.

5. It is the contention of the petitioner that the private respondent not meeting all the requirements was given the license, and the petitioner in spite of meeting all requirements and being suitable in all the category was not granted license.

6. It is stated that the private respondent has several pending criminal cases against him and the godown which has been shown is also not his exclusive property.

7. Finally, the Learned Counsel for the petitioner submits that all these grievances are part of his representation dated 17th October, 2025, being 'Annexure-P-7', to the writ application.

8. It is submitted that if the said application is considered by the authority, his grievance will be met.

9. Accordingly, the District Controller Food And Supply, South 24-Parganas, shall consider the petitioner's representation dated 17.10.2025, on hearing the parties, within 60 days from the date of the receipt of a copy of this order, by passing a reasoned order, in accordance with law.

10. The writ application is disposed of.

11. Applications, if any, connected thereto stand disposed of consequently.

12. Interim order, if any, stands vacated.

13. Photostat certified copy of this order, if applied for, be given to the parties on priority basis upon compliance of all formalities.
