Mr. U.K. Jana Mr. A.K. Chakraborty ....for the petitioner Mr. Sk. Md. Galib Ms. Priyamvada Singh ....for the State The petitioner claims to be the owner of a plot of land a portion of which was acquired for the purpose of widening of the national highways.

Since the petitioner claims that a portion of a particular plot was acquired, petitioner approached the Collector, Paschim Medinipur by submitting a representation praying for demarcation of the acquired portion of the plot in question so that the petitioner can utilize the portion of his property which is not subject matter of any acquisition proceeding.

Petitioner submitted a representation before the Collector, Paschim Medinipur as well as other authorities dated September 24, 2025.

Mr. Galib, learned Senior Government advocate appears and submits that several issues were raised in the representation dated September 24, 2025 and one of such issues pertains to correction of L.R. Record of Rights. He submits that the authority who has been vested with the

power to correct the Record of Rights is an authority under the specified Act under the West Bengal Land Reforms & Tenancy Tribunal Act, 1997 and any inaction on the part of an authority in that regard cannot be challenged in a writ petition and the person aggrieved has to approach the Tribunal constituted for such purpose.

After going through the representation dated September 24, 2025 this Court finds that several issues including the prayer for correction of L.R. Record of Rights have been raised.

Faced with such situation, the learned advocate appearing for the petitioner submits that the immediate grievance of the petitioner is with regard to demarcation of the portion of the plot in question which has been acquired.

In view thereof, WPA 25307 of 2025 stands disposed of by giving liberty to the petitioner to file a representation before the Collector, Paschim Medinipur with regard to her claim for demarcation of the portion of the acquired land in question and if such a representation is submitted, the State respondent shall consider the same and take steps for demarcation of the plot in question in accordance with law.

It will be open to the said respondents to take the help of the concerned Block Land & Land Reforms Officer and any other authorities whose assistance may be necessary for the purpose of conducting the work of

demarcation and the demarcation sketch map shall be supplied to the petitioner and any other interested parties immediately thereafter.

The entire exercise shall be completed as expeditiously as possible but positively within a period of 8 weeks from the date of receipt of a server copy of this order along with a copy of the representation permitted to be submitted pursuant to this order.

With regard to the other reliefs namely, correction of Record of Rights and the demolition of illegal construction the petitioner will be at liberty to approach the appropriate authorities in accordance with law at the appropriate stage.

There will be no order as to costs.
