The petitioner claims higher pay scale for having obtained postgraduate qualification in the year 2001. The petitioner admittedly was appointed as an Assistant Teacher in a graduate post in the year 2003. Admittedly, the post requires teaching of students' below class VIII in a secondary school.

The petitioner has not claimed any benefit of postgraduate pay scale at the time of entry into the post. He joined a graduate post and that too despite having a prior postgraduate degree.

Reliance is placed on a memorandum of the Education Department dated 12th February 1999. The said memorandum cannot assist the petitioner since the said circular has no application in the facts of the case. In that view of the matter, no relief can be granted to the petitioner.

With the aforesaid observations, the writ petition shall stand disposed of without any orders.

Interim orders, if any, shall stand vacated.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
