The petitioner's prayer seeking higher scale of pay forwarded by the school authority has been pending consideration before the District Inspector of Schools (SE), Purulia for more than a year.

Learned counsel for the State is not ready with proper instructions.

As it appears that the representation of the petitioner is pending consideration before the concerned DI of Schools, accordingly, the instant writ petition is disposed of by directing the said DI of Schools to consider the petitioner's prayer for grant of higher scale of pay strictly in accordance with the relevant rules and the law laid down by the Court from time to time. A decision shall be taken at the earliest but positively within a period of twelve weeks from the date of communication of this order.

An opportunity of hearing shall be provided to the petitioner for production of necessary documents in support of his claim including the judgments relied upon.

A reasoned order shall be passed and communicated to the petitioner forthwith thereafter.

If the prayer of the petitioner is allowed then necessary consequential step for disbursing payment shall be taken without any further delay. 7.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
