1. Parties are represented through their learned counsel.

2. Learned counsel for the petitioners submits that during the pendency of this petition, a new Addendum-IV dated 25th February, 2025, came into being which relaxed the previous impediment pursuant to which candidature of dependent of a regular employee for compassionate appointment was confined only against regular posts whereas as per Addendum aforesaid, now such candidates may be considered against GDS posts as well. In this view of the matter, the impugned order may be set aside and O.A. may be restored to its original number so that the present petitioner may file appropriate application for amendment to assail the previous policy (if necessary) which deprived him from right of consideration against GDS post and argue the matter afresh after completion of pleadings.

3. The other side raised no objection to this innocuous prayer.

4. As agreed, the impugned order dated 4th January, 2024, passed in O.A. 350/1658/2018 is set aside by reserving liberty as prayed for.

5. The tribunal is well-advised to rehear the parties after completion of pleadings and decide the matter afresh.

6. This court has not expressed any opinion on merits.

7. Petition is, accordingly, disposed of.

8. Urgent Photostat certified copy of this order, if applied for, be given to the parties, on priority basis, upon compliance of all necessary formalities.
