1. Report filed by the State today, be kept with the record.

2. Learned counsel, Ms. Debanth appearing on behalf of the victim has submitted that the victim has instructed her to submit that the present petitioner has actually helped her to come out from the profession of prostitution and she has no allegation against the present petitioner.

3. The learned counsel for the petitioner has drawn the attention of this Court to the statement of victim girl recorded under Section 164 of Cr.P.C and has also taken me to the relevant order passed by the Hon'ble Division Bench on 11.07.2023 in CRM (DB) 2716 of 2023.

4. The learned counsel for the State has left the matter to the discretion of this Court.

5. After considering all the materials on record, it appears that this is a fit case for quashing of the entire proceedings pending before the concerned Court. In

doing so, I have considered the statement of the victim girl recorded under Section 164 of Cr.P.C, the order of the Hon'ble Division Bench passed on 11.07.2023 in CRM (DB) 2716 of 2023 and also the submission of the learned counsel, Ms. Debnath appearing on behalf of the victim. Considering all aspects, the relevant G.R. Case arising out of 154 of 2023 dated 24.03.2023 under Sections 363/365 of the Indian Penal Code and Sections 4/17 of the Prevention of Children from Sexual Offences Act, 2012 read with Section 9 of Prohibition of Child Marriage Act be quashed. The accused be set at liberty at once and be discharged from his bail bond.

6. Accordingly, CRR 4138 of 2023 is disposed of.

7. Let a copy of this order be sent to the learned Trial Court immediately.
