Petitioner submits that he is in custody for 3 years 6 months and till date out of 28 witnesses proposed to be examined, prosecution has only examined 6 witnesses and the examination in respect of the PW.7 is in progress.

On the other hand, learned advocate appearing for the State submits that the Presiding Officer of the court was absent on the last few dates. Additionally, charge was framed on 10th September, 2022 and since then prosecution has been able to complete 6 witnesses. The next date, according to the State, has been fixed on 12th December, 2025.

In case the learned trial court is not available, the court which will be in charge of the trial court would continue with the evidence of the case.

The Superintendent of Police, Ranaghat Police District

would engage an Officer in the rank of DSP/SDPO who would monitor regarding the availability of the witnesses on the next date fixed by the learned trial court. The learned trial court would ensure that at least 15 more witnesses are examined by 30th April, 2026. The trial of the case would continue in respect of resolution of the local bar and no unnecessary adjournment be given to either of the parties.

With the aforesaid observations, at this stage, CRM (M) 2256 of 2025 is dismissed.
