The petitioner is aggrieved by the order passed by the learned Judge, Bench-II, City Sessions Court, Calcutta on 27th September, 2024 in Special case ACB no. 13 of 2019 on the ground that the application filed by the petitioner for return of relied upon and unrelied upon documents pertaining to AC B P.S. case no. 15 of 2019 has not been disposed of. Learned Judge directed the holding officer to submit a further report clarifying whether the alamat mentioned in the application were re-seized in connection with any other case. The application is pending for report to be submitted by the holding officer. Learned counsel for the State submits that the next date for hearing of the application has been fixed on 16th January, 2025 and the holding officer shall positively submit the report as called for before the learned Judge on the said date.

In view of the above, the learned trial Court is directed to dispose of the application filed by the petitioner dated 20th June, 2024 under Section 451 of the Code of Criminal Procedure on the next date of hearing fixed before him and if the same is not possible due to unavoidable circumstances, within one month thereafter, without

granting any unnecessary adjournment to either of the parties, in accordance with law.

CRR 4470 of 2024 is disposed of.
