Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the widow of a former serviceman. Her husband had build a house on their property. The private respondents belong to the ruling political dispensation. They are miscreants of the locality and are of desperate nature. They had encroached upon a portion of the petitioner's property and had constructed a party office there. They also committed arson in the property of the petitioner. A complaint was made before the police authorities, but no steps were taken.
Learned AGP representing the State relies on the report and submits as follows. A specific FIR has been
lodged on the complaint of the petitioner being Bhupatinagar Police Station Case No. 150 of 2023 dated 30.04.2023 under Sections 143, 427, 436 and 506 of the Penal Code. During investigation, the Investigating Officer arrested two FIR named accused namely, Soumyadip Dey and Bardhendu Bhunia. The burnt articles were seized from the place of occurrence and sent to the SFSL for necessary examination. Investigation is going on. However, at present there is no party office on the land of the complainant. The office which was there has been completely destroyed. Close watch is being kept on the developments in the locality. Report filed on behalf of the petitioner indicates that the private respondents have been served with notice. It appears that on the complainant of the petitioner, the police have taken steps by registering an FIR, seizing burnt articles from the place of occurrence and even arresting two accused.
Let the Superintendent of Police, Purba Medinipur engage an Officer of the rank of DSP to supervise the investigation. The Investigating Officer shall conclude the investigation expeditiously and in accordance with law. The police authorities shall keep a sharp vigil at the locale and ensure that no breach of peace takes place. In the event, any untoward incident occurs or is apprehended by the petitioner, the petitioner shall be at liberty to call up the Officer in Charge of the local police station who shall then act in accordance with law.
With these observations, the writ petition is disposed of.
