Petitioner complains that there has been no progress in the case in spite of charge sheet having been submitted and charge being framed. It has been contended that for 1 year and 12 days the petitioner is in custody and from the exclusive possession of the petitioner 23 Kgs. of Ganja/contraband were recovered while from other accused persons 101 Kgs. of Ganja/contraband were recovered.

Having considered that commercial quantity of contraband has been seized, in this case, I am of the view that the petitioner is unable to overcome the rigors of Section 37 of the NDPS Act.

As such the prayer for bail of the petitioner is rejected.

Petitioner complains that his son is suffering from certain ailments. Consequently, the learned Trial Court is directed to take steps for expediting the progress of the trial. With the aforesaid observations CRM (NDPS) 1417 of 2025 is dismissed.
