The petitioners are the tenants in respect of the premises in question under the private respondents and allege that they have been driven out of the premises by the private respondents without taking recourse to law. Their belongings are lying in the premises and several approaches made to the police authority for recovery of their belongings have not been considered.
Learned counsel for the petitioners submits that the petitioners filed a title suit before the learned civil Judge (Junior Division), Bidhannagar, North 24 Parganas wherein by an order passed on September 26, 2025, the learned trial Court granted an order of ad interim injunction restraining the private respondents herein from disturbing the peaceful possession of the petitioners in respect of the property. During pendency
of the suit the petitioners have been dispossessed therefrom. Learned counsel submits that necessary steps have been taken before the learned trial Court in view of the subsequent development.
It appears from the report submitted by the State that the entire premises has been demolished and new construction is going on therein.
Since the petitioners seek recovery of possession as well as his belongings which, according to them, are lying in the rented premises, they are at liberty to ventilate their grievance before the learned trial Court. In the meantime, the police authority shall keep strict vigil in the area in order to avoid any untoward incident in view of the strained relationship between the parties and shall also ensure maintenance of peace and tranquility.
The writ petition is accordingly disposed of. There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
