The petitioner's prayer seeking higher scale of pay is alleged to be kept pending before the District Inspector of Schools (S.E), Nadia.

Learned advocate representing the State respondents has obtained instruction from the District Inspector of Schools (S.E), Nadia wherefrom it appears that the prayer of the petitioner has been rejected on the ground that the petitioner did not obtain prior permission from the District Inspector of Schools for admission in the higher study.

No document sanctioning the study leave by the West Bengal Board of Secondary Education has been found.

As it appears that the District Inspector of Schools has already taken a decision on the prayer of the petitioner, accordingly, the District Inspector of Schools is directed to make a formal communication of the decision to the petitioner so that the petitioner may take steps to challenge the same in accordance with law.

5.

The communication by the District Inspector of Schools shall positively be made within a fortnight from date.

The writ petition stands disposed of.

7.

Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
