The State of West Bengal & Ors.

Mr. Habibur Rahaman Mr. Archisman Singh Mr. Mehebuba Rahaman ...for the Petitioner Mr. Rajarshi Basu Mr. K.M.Hossain ....for the State Affidavit of service filed by the petitioner and report submitted by the State are taken on record. It appears that the title suits by and between the parties are pending before the competent civil Court wherein orders of injunction are in force. The police authority has been directed to implement the said orders.

The petitioner complains that the police authority restrained him from raising construction in his property and also demanded huge bribe from him which had to be paid by him.

Learned counsel for the petitioner submits that after filing of the writ petition, the petitioner has been continuing with the construction in his property. It appears from the report submitted by the State that the complaint lodged by the petitioner against respondent nos. 11 and 12 have been considered and

enquiry was held. It was found that the allegation of the petitioner was not substantiated.

Since the dispute between the parties is subjudice before the civil Court, no fruitful purpose shall be served in keeping the writ petition pending. The same is disposed of accordingly.

However, the police authority is directed to keep strict vigil in the area in order to avoid any untoward incident in view of the strained relationship between the parties and to ensure maintenance of peace and tranquility.

There shall, however, be no order as to costs. Since no affidavit is invited, the allegations contained in the writ petition are deemed not to have been admitted.
