Affidavit of service filed on behalf of the petitioner is taken on record.

Petitioner participated in the selection process for being appointed as Constable (GD) in Central Armed Police Forces (CAPFs). Petitioner qualified in the test and medical examination as it is submitted by learned advocate but on measurement height of the petitioner was measured as 168.1 cm. whereas requisite height is 170 cm. It is submitted on behalf of the petitioner that petitioner preferred an appeal before the Appellate Authority as per norms on 16th September, 2025 but same is yet to be decided.

Union of India is represented by learned advocate who has submitted that as per norms

though there is appeal provision but at present Appellate Authority is not available.

In view of submissions made on behalf of the parties, Court grants leave to the petitioner to make a representation to the Regional Director, Staff Selection Commission, Eastern Region being respondent no. 3 questioning measurement of his height as made by the concerned authority in connection with petitioner's participation in selection test for being appointed as Constable (GD) within a period of seven days from date. If such representation is made within aforesaid time to respondent no. 3, same shall be decided by respondent no. 3 by seven days thereafter.

Decision to be taken by respondent no. 3 shall be communicated to the petitioner by forty-eight hours thereafter.

Since no affidavit is called for, allegations contained in the writ petition are deemed not to have been admitted.

The writ petition stands disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties on usual undertakings.
