Petitioner is aggrieved by the fact that he is being harassed by his son and daughters in the peaceful enjoyment of the property.

To that effect petitioner has already approached the Civil Court and the learned Civil Judge, Junior Division, 3rd Court, Baruipur, South 24 Parganas in T.S. 722/2022 has passed an order directing the defendants not to disturb the peaceful possession of the suit property and also not to oust the plaintiff of the Suit property.

Learned advocate for the petitioner submits that the said interim order has been extended from time to time.

Be that as it may, the dispute is between the father and the children. As the Civil Court is in seisin of the matter I grant liberty to the petitioner

to approach the Civil Court with specific prayers for police assistance for implementing its order. In case the Civil Court passes any direction, the Police authority would respect and obey such order.

Police authorities are directed to keep a strict vigilance and ensure that no untoward incident occurs involving the present of the petitioner and the private respondents.

With the aforesaid observations being WPA 25795 of 2024 is disposed of.

Learned advocate for the State would communicate this order to the jurisdictional Police Station.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
