Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner is the father of the victim (deceased). The victim was working as a constable in the RPF and was posted at the Chandini Metro Railway Station. The victim had an affair with the respondent no. 6. In fact, he was engaged to marry the said respondent. However, the said respondent and her relatives and others did not want to go ahead and started threatening and pressurizing the victim. It is suspected that the private respondents conspired and killed the victim. A complaint was made to that effect before the police. However, a case being Bowbazar P.S. case no. 304 dated 28.12.2023 has been initiated and is being continued only under Sections 306/506/34 of the Indian Penal Code. In collusion with the accused, the police have not taken proper steps in the investigation.
Learned senior Standing counsel appearing on behalf of the State relies on the report and submits as follows. A thorough investigation is being done in the instant case. All witnesses available were examined. Relevant CCTV footages were collected. It has come out that the engagement between the respondent no. 6 and the victim was broken by the victim himself because he allegedly found out that the respondent no. 6 was having another affair. An agreement was entered into between the private parties recording the fact that the engagement was broken On the fateful day, the petitioner came to some of the witnesses who also worked in the RPF and stated that he wanted to end his life. Then, he started vomiting. When asked, the victim pointed to a place where he had kept a bottle of poison from which he had consumed some.
All these were duly recorded and witnesses examined. Even the allegation of relatives of the petitioner that the victim was receiving threat calls is being looked into. It appears that the investigating agency has taken necessary steps in investigating the case. It is open to the investigating agency to come to a conclusion after collecting all evidence and upon taking them to consideration. Let the investigating agency conclude the investigation expeditiously and in accordance with law. If the petitioner is aggrieved with the outcome of investigation, he shall be at liberty to file a protest petition before the learned Trial Court.
No further order need be passed in this regard. With these observations, the writ petition is disposed of.
