By the present writ petition the petitioner seeks direction upon the respondent authorities to cause an enquiry and take appropriate steps against the Headmaster, Niramisha Free Primary School and the Panchayat Pradhan, Amuliya Gram Panchayat, respondent Nos.6 and 7, respectively and also to provide police protection to the petitioner so that she can attend her duties in the school within a specified period.

The petitioner contends that she was posted as an Assistant Teacher in Niramisha Free Primary School, Deganga under North 24-Parganas District Primary School Council. The petitioner was harassed by the Headmaster of the said school and other authorities. Subsequently, on 30th July, 2024 the petitioner made a complaint before the Chairman, District Primary School Council, North 24-Parganas. Thereafter, the
petitioner has been transferred to Dhabdhara F.P. School on 29th October, 2024. The Career Advance Scheme (CAS) has also been withheld. Since no action has been taken from the side of the respondent authorities the petitioner has preferred the present writ petition.

Ms. Susmita Dey (Basu), learned Advocate for the petitioner submits that although date was fixed for hearing on the complaint of the petitioner, however, the petitioner has not been intimated of the date of hearing. She seeks that the complaint of the petitioner be enquired by authority concerned upon notice to the petitioner.

Despite service none appears on behalf of the District Primary School Council, North 24-Parganas.

Learned advocate for State leaves the matter to the direction of the Court.

By a notice dated 20th March, 2025, the Chairman, District Primary School Council, North 24-Parganas asked the petitioner to remain present in a hearing to be held on 9th April, 2025 at 3.15 p.m. Copy of the said notice was sent to the Headmaster, Dhabdhara F.P. School. Be that as it may, the notice shows that copy of the same has not been forwarded to the petitioner. 7.
In view of the above, the Chairman, District Primary School Council, North 24-Parganas, respondent no.3 is directed to consider the complaint of the petitioner dated 30th July, 2024 and dispose of the same, in
accordance with law, upon notice to the petitioner, within a period of eight weeks from the date of communication of this order.

The reasoned order shall be communicated to the petitioner one week thereof.

Petitioner is directed to serve the copy of this order upon the Chairman, District Primary School Council, North 24-Parganas, respondent no.3, for necessary compliance.
10. With the above direction, the writ petition being WPA 25816 of 2024 stands disposed of.
11. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.
12. Interim order, if any, stands vacated.
13. All connected applications, if any, stand disposed of.
14. There shall be no order as to costs.
15. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.
16. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
