Mr. Suman Ghosh, learned counsel who is present in Court and usually appears for the State is requested to represent the State in this matter. His appointment be regularised by the appropriate authority. The petitioner is directed to serve copy of the application along with annexure thereto upon Mr. Ghosh in course of this day.

The petitioner alleges that the complaint lodged by him before the police authority has not been acted upon.

In view of the law laid down by the Hon'ble Supreme Court in Aleque Padamsee and others vs. Union of India and others reported in (2007) 6 Supreme Court Cases 171 the petitioner is at liberty to approach the jurisdictional Magistrate under Section 175 of the BNSS for redressal of his grievance. The writ petition is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
