...for the State The grievance of the petitioner is directed against non-consideration of a representation dated July 17, 2023. It is submitted on behalf of the petitioner that despite a representation seeking steps against a Caste Certificate issued in favour of the private respondent, no steps have been taken by the concerned Sub Divisional Officer.

The State respondents are represented and do not object to the representation being considered by the concerned Sub Divisional Officer in accordance with law.

In view of the above, W.P.A. No. 24660 of 2023 stands disposed of by directing the Sub Divisional Officer, Jangipur S.D.O.

Office, being the respondent no. 5 herein, to consider and dispose of the representation of the petitioner dated July 17, 2023 within a period of six weeks from the date of

communication of this order to the said respondent after giving a right of hearing to the concerned parties, in accordance with law and without being influenced by any of the observations or directions made in this order.

It is made clear that there has been no adjudication on the merits of the case and all questions are left open to be decided by the respondent no. 5 strictly in accordance with law. The petitioner shall forward a copy of the representation dated July 17, 2023 to the Sub Divisional Officer, Jangipur S.D.O. Office and the concerned Sub Divisional Officer shall act in terms of the above order upon receipt of the same.

Since no Affidavits have been called for in the matter, it is deemed that none of the allegations made in the writ petition are admitted by the respondents.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be made available to the parties upon compliance of necessary formalities.
