By the said order, this Court held that WPA 24666 of 2023 is not maintainable before this Court as the court of first instance granting liberty to the petitioner to approach proper forum in accordance with law.

Learned advocate appearing for the petitioner submits that writ petitioner can maintain the petition before this Court.

I am of the view that the maintainability issue was decided after a contested hearing.

I am not inclined to reopen the issue in this recalling application. The petitioner, if aggrieved by the order, may take recourse to appropriate proceeding in accordance with law.

Accordingly, CAN 1 of 2024 is dismissed.
