This is an application assailing an order dated 9th August, 2019 passed by the learned Additional Sessions Judge, 3rd Fast Track Court at Barasat in Sessions Case No. 581/2017 directing issuance of warrant of arrest against the petitioner.
It is submitted by the learned Advocate for the petitioner that the petitioner initially was arrested and thereafter he was granted bail. He was all along present and on the date of consideration of charge the petitioner was present and charge was framed against him. However, on subsequent two dates he could not appear before the Court. The learned Advocate for the petitioner also did not take any step on behalf of him and accordingly the Trial Court issued warrant of arrest against him.
The petitioner submits that he intends to surrender before the Trial Court and on his voluntary surrender, Trial Court may be directed to take lenient view in respect of the application for bail that will be filed before the Trial Court on the date of his surrender.
In view of such submission the petitioner is directed to surrender before the Trial Court within two weeks from the date of this order. In the meantime, operation of the warrant of arrest will be stayed for a period of four weeks.
If the petitioner surrenders before the Trial Court in compliance of this order within the time limit as prescribed, the learned Trial Judge shall consider as to whether he can be provided with the benefit of further bail or not. The instant revision is, thus, disposed of.
