1. The Status Report of Kumarchak S.K.U.S. Ltd. filed in Court today be taken on record.

2. The present writ petition has been filed for a direction upon the respondent Nos. 3 to 5 to re-constitute the Board by convening the election of delegates of the cooperative society which has been long pending, though a resolution has been taken by the Board of the Society on 4th December, 2022.

3. Records would also reveal that previously the petitioner moved a writ petition which was registered as WPA 27663 of 2022 for a direction upon the authorities to convene and complete the elections. It is submitted that though by order dated 4th January, 2023 a Coordinate Bench of this Court had directed the concerned respondents to initiate and conclude the election within six months the same has not been acted upon.

4. Today Mr. Nayek learned advocate appearing on behalf of the West Bengal Co-operative Election Commission has placed before this Court an election schedule

published by the Assistant Returning Officer, Kumarchak S.K.U.S. limited and would submit that already steps have been taken for distribution, scrutiny of nomination papers and publication of valid nominations for the contesting candidates. From the aforesaid document, it however does not appear that the date for holding election has been finalized. Let a copy of the above schedule as placed before the Court be taken on record.

5. Having regard to the above, I direct the West Bengal Co-operative Election Commission and the Assistant Returning Officer, Kumarchak, S.K.U.S.

to forthwith take steps for publishing the date for holding election of delegates of the Kumarchak S.K.U.S. Limited unless the same has already been published, within a period of one week from the date of communication of this order.

6. Since nothing survives in the aforesaid writ petition for further consideration, let the writ petition be disposed of accordingly.

7. There shall be no order as to costs.
