Matter relates to the eligibility of the petitioner to be considered as a candidate who can be appointed on the post of Assistant Teacher in Upper Primary section in a Government aided secondary school since petitioner was not having training qualification at the material point of time. Though petitioner participated in 1st SLST 2016 (Upper Primary) but it has been submitted on behalf of the petitioner that till the cut off date of 24th October, 2016 petitioner was not having training qualification.

It is submitted by the learned advocate for petitioner that she obtained training qualification in the year 2020.

The learned advocate representing the Commission submits that in the second phase of selection process which was conducted in terms of the order of a coordinate Bench the petitioner did

not participate by uploading her testimonials though similarly circumstanced other candidates participated on uploading documents.

Such submission made on behalf of the Commission is disputed by the learned advocate representing the petitioner and it is submitted that she participated in the second round of selection process which started from Rule 12(2) stage.

Participation of the petitioner being an untrained candidate in the second round of selection process does not make any difference since it has been submitted on behalf of the Commission that not a single candidate who obtained training qualification after 24th October, 2016 was adjudged as an eligible candidate even though those candidates uploaded their testimonials in second phase of selection process. In view of aforesaid facts and since the petitioner failed to obtain training qualification within the cut off date of 24th October, 2016, no relief can be granted to her.

Accordingly, writ petition stands dismissed.

However, there shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for parties on usual undertakings.
