The petitioner is a retired headmaster. He seeks additional increment of 3% in terms of the Memorandum No.30-SE(B)/5B-1/2009 dated 10th February 2010.

Submission is that he taught in the upgraded school and would be entitled to the additional increment in terms of the above memorandum.

Upon hearing the submission made on behalf of the petitioner, it appears that the petitioner is yet to apply for release of the additional increment. 4.

In view thereof, the instant writ petition is disposed of by observing that it will be open for the petitioner to apply before the Commissioner of School Education for grant of additional increment in terms of the memorandum dated 10th February 2010.

The aforesaid authority shall consider the application, if any, made by the petitioner in terms of the aforesaid memorandum.

A decision shall be taken by the aforesaid authority in accordance with law at the earliest but positively within a period of eight weeks from

the date of filing the application by the petitioner. 7.

If the prayer of the petitioner is allowed, then necessary consequential steps shall be taken by the aforesaid authority.

Learned counsel for the petitioner is directed to forward a copy of all relevant notifications and judgments of this Court in his support at the time of forwarding the application for grant of additional increment.

The writ petition stands dispose of.

All parties are to act on the server copy of this order duly downloaded from the official website of this Court.

Certified copy of this order, if applied for, shall be made available to the parties.
