It is submitted by the Advocate appearing on behalf of the petitioner that notwithstanding having filed a complaint in respect of the alleged illegal construction being carried out by the private respondents in the subject premises the State-respondents have taken no steps whatsoever.

The State-respondents are represented.

Mr. Chattopadhyay, Advocate appearing on behalf of the State-respondents submits that appropriate proceedings under the Code of Criminal Procedure have been initiated by the State-respondents against the private respondents. He also submits that no portion of the subject premises has been acquired by the Staterespondents.

I am of the view that in view of the fact that the State-respondents have initiated criminal proceedings against the private respondents there is no purpose of keeping this writ petition alive.

Accordingly, WPA No. 23102 of 2019 is disposed of by directing the State-respondents to take appropriate steps in accordance with law and conclude the proceedings as expeditiously as possible.

WPA No. 23102 of 2019 stands disposed of.

There shall be, however, no order as to costs. (Ravi Krishan Kapur,J)
