Learned advocate appearing for the petitioners submits Bpg.

Allowed that the petitioners are in custody for about 168 days. The investigation of the case has already been concluded and chargesheet has been submitted before the jurisdictional court. Learned advocate for the State, on the other hand, opposes the prayer for bail and submits that each of the petitioners are thickly connected with the alleged offence and dates have been fixed for consideration of charges.

I have considered the case diary particularly the statement of the child and on assessment of the same, I am of the opinion that so far as the petitioner no.1, namely, Surajit Sit @ Shit is concerned, he may be released on bail. So far as the petitioner no.2, namely Lakshman @ Laxman Sit @ Shit and the petitioner

no.3, namely, Sandhyarani Sit @ Sandhya Shit are concerned, their prayer for bail is rejected at this stage.

Accordingly, the prayer for bail of the petitioner no.1 is allowed. The petitioner no.1, namely Surajit Sit @ Shit shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned ACJM, Kakdwip.

If on bail, the petitioner no.1 shall make himself available on each and every ate so fixed by the learned trial court and will cooperate with the learned trial court. The petitioner no.1 shall meet with the Officer-in-Charge, Gobordhanpur Coastal Police Station once in a fortnight until further orders of this Court.

With the aforesaid observations, CRM(M) 2268 of 2025 is partly allowed.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
